1. Eligibility and Location

By using this App, you confirm and warrant that:

• You are 18 years of age or older;
• You are currently located in Australia; and
• You have the legal capacity to enter into these Terms.

2. User Conduct and Prohibited Content

You are solely responsible for all content you post, upload, or otherwise make available through our App ("User Content"). You agree that you will not post any User Content that:

• Is defamatory, harassing, or abusive toward any person or business;
• Contains unverified accusations of criminal conduct;
• Is false, misleading, or intentionally deceptive;
• Promotes racism, bigotry, hatred, or physical harm against any individual or group;
• Is unlawful or promotes illegal activity, including fraud or phishing;
• Constitutes spam, unsolicited advertising, or impersonation of another person or entity; or
• Interferes with the App's functionality, introduces malware, or scrapes data without our written permission.

3. Moderation Rights

We reserve the right, but assume no obligation, to review, moderate, remove, or edit any User Content at our sole discretion, at any time, and without notice. We have no obligation to display or host any User Content.

4. Neighbours and Third-Party Content

User Content about neighbours, businesses, or other third parties reflects the user's personal experience and is not verified by us. We do not endorse or guarantee the accuracy of any such content.

If you are a neighbour, business, or individual mentioned in a review and believe it is inaccurate or defamatory, please refer to our Reporting Mechanism in Section 10. We welcome affected parties to submit a public response to a review, which we may publish at our sole discretion.

5. Intellectual Property License

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable, and transferable license to display, reproduce, distribute, modify, and perform your User Content on the App and for our legitimate business purposes.

You retain all ownership rights to your User Content.

6. Anonymity and Disclosure

User Content is published under a randomly generated ID. However, anonymity is not absolute. If we receive a valid court order, subpoena, or other legal request requiring us to disclose your identity or information, we will comply as required by law.

7. Indemnity

You agree to indemnify, defend, and hold harmless JARACZEWSKI HOLDINGS PTY LTD, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising directly or indirectly from:

• User Content you post;
• Your use of the App;
• Your violation of these Terms; or
• Your violation of any applicable law or the rights of any third party.

8. No Liability (Disclaimer)

To the maximum extent permitted by the laws of Queensland, Australia:

• We are not responsible for the accuracy, completeness, or truth of any User Content.
• All User Content reflects the views of the user, not the platform.
• We provide the App on an "as is" and "as available" basis, and we make no warranties, express or implied, regarding its operation or availability.
• We will not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Termination

We may suspend or terminate your access to the App at any time, for any reason or no reason, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

10. Reporting Mechanism (Defamation and Complaints)

If you believe any User Content on our App defames you, violates your rights, or is otherwise unlawful, please contact us immediately at:

Your complaint must include:

• Your name and contact information;
• Sufficient details to identify the specific User Content (e.g., link, screenshot, username);
• A clear statement explaining why the content is defamatory or violates your rights; and
• Any supporting documentation.

We will review all valid complaints and respond within 7 business days. This process complies with applicable defamation laws and provides our safe harbour.

11. Electronic Communications

By using the App, you consent to receive electronic communications from us (e.g., via email or in-app notifications). You agree that all agreements, notices, and disclosures we provide to you electronically satisfy any legal requirement that such communications be in writing.

12. Apple App Store (Additional Terms)

This App is distributed via the Apple App Store. To the extent that these Terms are less restrictive than the Apple Media Services Terms and Conditions or the App Store Usage Rules, the Apple Media Services Terms and Conditions and Usage Rules will apply.

13. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. Any disputes arising out of or in connection with these Terms or your use of the App will be resolved exclusively in the courts of Queensland.

14. Entire Agreement

These Terms constitute the entire agreement between you and JARACZEWSKI HOLDINGS PTY LTD regarding your use of the App and supersede all prior understandings and agreements, whether written or oral.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

16. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing to be effective.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such notice constitutes your acceptance of the revised Terms.
